Billboard competition terms of Use

1. Introduction

My Online Presence (Pty) Ltd is running a competition that is linked to the Unseen Heroes website. By entering your information on our website and by voting for our business on the Unseen Heroes website, you stand a chance to win a R10 000 cash prize.

2. Definitions in this Agreement

2.1 Participant, or you, means the person who enters their details on My Online Presence’s website or the person voting for our business on the website.

2.2 Promoter means My Online Presence (Pty) Ltd or its agencies used to promote this competition.

3. Duration

The competition will run from 00h00 on 20 November 2019 until 16h00 on 3 December 2019. The Unseen Heroes Billboard winner will be announced on 3 December 2019 at an event at Emperors Palace in Johannesburg. If My Online Presence wins the Billboard prize, a winner will be randomly selected after the event and the winner of the cash prize will be announced soon after 3 December 2019.

4. Participation

4.1 The competition is conducted by the promoter and its third party contractors.

4.2 No one who is a director, employee or agent of or consultant to us or who is a spouse, life partner, close family member, business partner, or associate to a director may take part or enter the Competition.

4.3 This competition is only open to legal residents of the South Africa.

4.4 You must have a valid South African ID when claiming a prize.

4.5 Entry into this competition is regarded as acceptance of these terms and conditions.

5. How to enter

5.1 To enter you must visit My Online Presence’s website, complete your details and then vote for My Online Presence on the website.

5.2 You may enter once by voting for My Online Presence.

5.3 We are not liable for any technical failure that may result in an entry not being successfully submitted.

5.4 Consumer Protection Act. Under the Consumer Protection Act (CPA), we need to keep records of all the people used to promote the promotional competition. We (or one of our subcontractors or affiliates) will keep this agreement for three years to serve as the record as required by the CPA.

6. No liability for Facebook or Twitter

6.1 The competition is in no way sponsored, endorsed or administered by, or associated with, Facebook or Twitter.

6.2 You release Facebook and Twitter of all liability for any damage you may suffer. You will be giving information to us and not to Facebook or Twitter.

7. Competition Reward

7.1 Prize. As a voter, you stand a chance to win a R10 000 cash prize, only if My Online Presence wins the Unseen Heroes Billboard competition.

7.2 Redeeming prize. If My Online Presence wins the Unseen Heroes billboard prize, we will award the cash prize after the close of the competition within a reasonable time.

7.3 Limitation to using your prize. Certain conditions may apply to redeeming your prize. We will not be responsible for any loss or damage caused by the participant not being able to collect the prize at a time that is convenient, or for providing us with incorrect information.

8. Prize winner selection and publicity

8.1 Choosing winners. The R10 000 cash prize winner will be determined by way of random selection, only when My Online Presence wins the Unseen Heroes Billboard prize. These votes must be from valid email addresses and limited to one person per vote.

8.2 How will you know if you have won. Winners will be contacted via email after they have been selected/after the lapsed time. Winners who have not given the promoters the correct details will forfeit the prize. We will attempt to contact the winner three times in a 72 hour period. If we do not receive a response, we will draw another winner.

8.3 We may ask winners to take part in publicity connected to this competition. Winners grant permission for us to use their names and photographs in any advertising and promotional material for this competition. You may ask us to remove your name or refuse to take part in any publicity.

8.4 You will not receive any payment for taking part in the competition, or taking part in any media format related to it.

8.5 The prizes are not transferable. You cannot ask us to give you another prize of similar value or to pay out the value of the prize. We may substitute any prize with another prize of similar value.

9. Breach and termination

If a party

9.1 does not fix any breach of this agreement within seven days of receiving written notice from the other party to do so;

9.2 is insolvent (bankrupt), or has some legal disability, for example, if they are placed under administration; then the other party may, without prejudice to any of its rights:

9.3 claim specific performance of this agreement (make the party comply with this agreement); or

9.4 immediately cancel this agreement in writing; and claim damages from the other party.

10. Dispute resolution

10.1 Arbitration. If there is any dispute, the parties must refer the dispute within 15 business days to arbitration (including any appeal against the arbitrator’s decision) under AFSA’s latest rules for expedited arbitrations.

10.2 CPA dispute resolution. Despite 10.1, any party may use other dispute resolution channels provided for by the CPA or other law.

10.3 Severability. This clause is separate and divisible from the rest of this Agreement and stays effective even if this Agreement ends or is invalid.

11. Force Majeure

11.1 Parties not liable. No party will be responsible for any breach of this agreement caused by circumstances beyond its control.

11.2 Notification. If a party cannot fulfil its obligations, because of matters beyond its control, it must notify the other party in writing within 10 days so that they can discuss the way forward.

12. General Rules

12.1 No liability. By taking part in this competition you agree that you will not hold us liable for any losses, harm, damages, injury, claims or actions related to this competition.

12.2 Changing the rules. These rules, including the duration of the competition, can only be reasonably changed (or superseded) by us in a written revision to these rules posted on the competition website or any other potential official competition communication methods we use to reach a majority of potential participants.

12.3 Tax. Income or other taxes relating to the prizes, if any, are the sole responsibility of the prize winner.

12.4 Governing laws. South African laws govern this competition.

12.5 Use of personal information. Participants understand and agree that in order to offer the competition, promoter must collect and use personal information about them.

12.6 Termination of the competition. If we need to, because of legislative or regulatory reasons, we may terminate the competition immediately and without notice. If this happens you will not have any claim against us, because of this.

The Personal Information My Online Presence collects from voters shall only be accessed by My Online Presence employees, representatives and consultants for the purpose and duration of this competition.
